Authorize.Net Terms of Service

A. General Terms

Authorize.Net, ("Authorize.Net") a CyberSource solution is providing this Developer's Community ("Community") as a service to allow you, our partners, to interact with and provide feedback to Authorize.Net on Authorize.Net products and programs. These Terms of Use and Authorize.Net Privacy Policy, located at http://www.authorize.net/company/privacy/, govern your use of this Community. By registering as a user or using the Community, you agree to abide by these terms. Authorize.Net reserves the right to modify these terms at its sole discretion at any time, effective upon posting of the modified terms on the Community. Any violation of these terms may result in the suspension or termination of your right to access the Community.

In consideration of your use of the Community, you agree that you are over the age of 18 and all information you provided during registration is accurate and complete. Authorize.Net may terminate your account if any of the information you provided is found to be inaccurate or incomplete.

Although the Authorize.Net Developer Community will be moderated and the moderators will actively interact with Community members, Authorize.Net does not guarantee that customer or technical support will be available through the community or that the support will be accurate or error free. If you need technical support, please contact developer@authorize.net.

B. Rules of Conduct

You acknowledge that you are solely responsible for the content and consequences of the material you post, including its legality, reliability, appropriateness, and trademark and copyright ownership. You grant Authorize.Net and the users of this Community the nonexclusive right and license to display, copy, publish, distribute, transmit, print, and use any such material. You agree that you shall not upload, post or transmit to or distribute through the Community, any materials (including text, links, communications, software, images, sounds, data, or other information) that may:

1. contain any confidential information of you, your company, Authorize.Net or any other person or entity, including, but not limited to, proprietary information, trade secrets, personally identifiable information, cardholder information and the terms of Authorize.Net related agreements;

2. be unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory or otherwise objectionable or injurious to third parties;

3. constitute or encourage conduct that is unlawful or would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law;

4. violate, plagiarize or infringe the rights of third parties including, without limitation, copyright, trademark, patent, trade secret, privacy or any other proprietary right; and

5. constitute advertising, junk mail, spam, chain letters, or any other form of unauthorized solicitation.

You also agree that you will not use any of the materials present on the Community in violation of applicable law, including, without limitation, the laws of the United States regarding the trading of securities.

C. Usage Guidelines

While using the Community, you agree that you will:

1. be courteous and respectful of others;

2. keep your post relevant to the payment industry and Authorize.Net's products, services and programs;

3. act responsibly to protect your and your company's private and confidential information; and

4. be careful, it is possible that the information on the Community could be incorrect, incomplete, unclear or misleading.

D. Moderator Role

In order to ensure the success of this Community, moderators will have privileges to edit/delete posts and posted materials, close threads, and block users from using the Community. Authorize.Net may remove any user or materials that, in its sole discretion, do not comply with the current Terms of Use or that are otherwise inappropriate for this Community, illegal, threatening, harassing, objectionable, or inaccurate. Authorize.Net is not responsible for any failure or delay in removing any such user or materials.

To report any concerns or possible violations of the Authorize.Net Community Terms of Use, please write to community@authorize.net. Please include the post's subject, the post author's screen name, the link of the post in question and any other applicable information in your email.

You may find posts that contain hyperlinks to content hosted and maintained by third parties. The linked sites are not approved or controlled by Authorize.Net and your access to any linked site is at your own risk. Authorize.Net makes no claim or representation regarding, and accepts no responsibility for, sites accessible by hyperlink from the Community.

F. Disclaimer of Warranties and Limitation of Liability

Material supplied by users of the Community is the sole responsibility of the person originating the material and Authorize.Net does not control and is not responsible for any such third-party material.

Authorize.Net does not warrant or guarantee the accuracy, reliability, completeness, usefulness, non-infringement of intellectual property rights, or quality of any material in the Community, regardless of who originates that material. You expressly understand and agree that you bear all risks associated with using or relying on the material. Authorize.Net will not be liable or responsible in any way for any content in the Community, including, but not limited to, any errors or omissions in the material, or for any losses or damage of any kind incurred as a result of the use of or reliance on any material. Any advice or information given by Authorize.Net, its employees or representatives, or any other users of the Community is provided "as-is" and without warranty of any kind, and your use of any such information is entirely at your own risk.

You agree to indemnify and hold Authorize.Net, and its subsidiaries, affiliates, officers, agents, and employees harmless from any claim, including reasonable attorneys' fees, made by any third party due to or arising out of materials you upload, post, or transmit to or distribute through the Community, your use of the Community and any materials contained therein, and your violation of applicable law or any rights of another.
